Aid and Attendance is a federal VA benefit

VA says Aid and Attendance is a monthly payment added to a qualified Veteran’s or survivor’s VA pension. A pension recipient may qualify when another person is needed for daily activities such as bathing, feeding, or dressing; when the person is bedridden; when the person is in a nursing home because of disability-related loss of mental or physical ability; or in the specified severe-vision circumstances (VA Aid and Attendance).

VA says Aid and Attendance and Housebound benefits cannot be received at the same time. It also says a nursing-home applicant needs VA Form 21-0779, while the medical examination information is completed on Form 21-2680 for the application methods it describes (VA Aid and Attendance).

Maine has six Veterans' Homes

Maine’s Bureau of Veterans’ Services Resource Guide lists six Maine Veterans’ Homes: Augusta, Bangor, Caribou, Machias, Scarborough, and South Paris. The Maine statute likewise requires homes in those six municipalities to remain in continuous operation absent the stated board process (Maine veterans resource guide; Maine Title 37-B §601).

The Resource Guide says State Veterans Homes provide nursing-home, domiciliary, or adult-day care and that VA helps defray care costs for eligible veterans. It also says VA coverage in that setting is for veterans, not non-veteran spouses or Gold Star parents accepted by a home (Maine veterans resource guide).

Maine property-tax relief for qualifying veterans

Maine Revenue lists a Veteran Exemption of $6,000 of a qualifying home’s just value for a veteran who served during a recognized war period and is 62 or older, receives 100% veteran disability, or became 100% disabled while serving. The listed filing deadline is April 1 with the assessor’s office (Maine Revenue property-tax exemptions).

Coordinate with MaineCare rather than assuming an exclusion

The fetched MaineCare materials do not provide a general state-specific rule declaring Aid and Attendance excluded from long-term-care income or cost of care. The Eligibility Manual does identify special $130 personal-needs treatment in certain VA-pension situations, which is not the same as a general A&A exclusion (MaineCare Eligibility Manual).

Report VA income and benefits to OFI and ask for a written determination of income and patient liability treatment. Coordinate VA, MaineCare, facility billing, and estate-recovery questions before choosing a payment source.
