What Maine may recover and when

The statute says recoverable MaineCare benefits are a claim against the deceased recipient’s estate. It permits enforcement through the probate process for assets included in the probated estate and by a claim in a court of competent jurisdiction for assets outside probate (Maine Title 22 §14). The state’s consumer page also cautions that recovery cannot exceed the amount MaineCare paid for covered services (MaineCare estate recovery).

For the age-55 and long-term-care-insurance-disregard claims, Maine cannot make a claim until there is no surviving spouse and no surviving child who is under 21 or blind or permanently and totally disabled. Maine’s consumer page states the same family protections and notes that recovery may be delayed while they apply (Maine Title 22 §14; MaineCare estate recovery).

Waiver and hardship routes

Title 22 requires a waiver when enforcement would create undue hardship under department criteria or when collection costs are likely to exceed recovery. It also permits a full or partial waiver, but bars one when the recipient or waiver applicant purposefully lost, diminished, divested, encumbered, or transferred property to prevent recovery (Maine Title 22 §14).

MaineCare’s public page describes a Care Given Waiver for a person who lived with the member for at least two years, provided care for at least two years that helped the member remain home, and meets income requirements. It lists possible waiver amounts up to $6,000, $12,000, or $32,000 per year depending on the stated level of care (MaineCare estate recovery).

Plan before death, not after notice
