Maine applies a five-year transfer review
Maine’s Eligibility Manual states that the look-back period is 60 months before the month in which a person is institutionalized and applies for Medicaid. The manual also applies a 60-month look-back to transfers involving trust assets (MaineCare Eligibility Manual). This aligns with the federal framework: CMS explains that the Deficit Reduction Act lengthened Medicaid’s long-term-care look-back to 60 months, or five years, before the application date (CMS transfer-of-assets backgrounder).
The review is not limited to a simple cash gift. Maine’s manual directs the agency to examine what was transferred, to whom, when, what was received in exchange, and why. It treats creating joint ownership, transferring real property while retaining a life estate, and transferring a life-estate interest as transactions that can require transfer analysis (MaineCare Eligibility Manual).
