Wartime service requirement

"Wartime veteran" means active duty during a federally declared war period, not necessarily combat service — World War II, the Korean War, the Vietnam War, or the Gulf War era all qualify, provided minimum active-duty service requirements are met. Surviving spouses of qualifying wartime veterans (who have not remarried) are also eligible.

The eligibility framework

• Medical need: requires help with at least two activities of daily living, or being bedridden, blind, or a patient in a nursing home due to physical or mental incapacity.
• Net worth test: countable assets (excluding the primary home and vehicle) must fall under a net worth limit that adjusts annually and is aligned with the Medicaid CSRA figure — see current figures on the VA's pension rate tables.
• Medical expense deduction: unreimbursed medical expenses, including the cost of in-home care or assisted living, can be deducted from countable income — which is often what makes a claim succeed even for veterans with modest additional income.

The three-year VA lookback

Since October 2018, the VA imposes its own three-year lookback on asset transfers when evaluating Aid & Attendance eligibility — similar in spirit to Medicaid's 60-month lookback but on a shorter timeline and with different rules. Coordinating a plan that captures Aid & Attendance income first, then transitions to Medicaid if higher-level care is later needed, is a specialized subfield within elder law.

Who it fits

Any wartime-era veteran, or the surviving spouse of one, who needs help with daily activities and has moderate assets and income.
