Utah may recover after a Medicaid recipient’s death
Utah Medicaid says that the Office of Recovery Services, Bureau of Medical Collections starts estate recovery after a recipient dies. The state says it may recover from the recipient’s estate or from a trust in which the recipient was grantor and beneficiary, and its current statute is titled Estate and Trust Recovery (Utah Medicaid Estate Recovery; Utah Code Section 26B-3-1013).
This is broader than a simple statement that only a probated house is at risk. Utah’s public page expressly includes the stated grantor-beneficiary trust category, and the statute says a trust term that denies recovery for medical assistance is void when made.
