Oklahoma applies the five-year transfer review
For transfers on or after February 8, 2006, OHCA’s ADvantage rule uses a look-back date 60 months before the first day the person is both institutionalized and has applied for SoonerCare. For this rule, an institutionalized person includes someone receiving ADvantage services. A transfer for less than fair market value by the individual, spouse, guardian, or legal representative can therefore affect both nursing-facility and waiver planning (OHCA ADvantage financial-eligibility and transfer rule).
The review is broader than a check made payable to a child. OHCA describes transfers as including a purchase, sale, gift, or change in how assets are held, and it identifies homes, other property, bank accounts, certificates of deposit, and cash as examples of assets. The current consumer nursing-facility page also warns that adding another person’s name to property may create an issue if fair market value was not received (OHCA long-term-care application information; OKDHS nursing-facility care guidance).
