Iowa applies a five-year transfer review
Iowa HHS states that a transfer of resources or countable income for less than fair market value can affect Medicaid LTSS payment when it is made within 60 months before application or after the application date. The resources manual uses the same 60-month, or five-year, framework for transfers on or after February 8, 2006 (Iowa HHS LTSS overview; Iowa HHS Medicaid Resources manual).
This is not a gift-tax label. HHS's policy calculates an LTSS payment penalty from the uncompensated equity value of transfers and looks at who transferred, when, to whom, and for what value. The same manual has exceptions and separate treatment rules, so a family should not assume every transfer to a relative produces the same result (Iowa HHS Medicaid Resources manual).
