Why Iowa needs its own long-term-care plan
Iowa calls its program Iowa Medicaid, and Iowa Health and Human Services administers the institutional and waiver eligibility rules. Long Term Services and Supports, or LTSS, can be delivered at home or in a facility; the state separately describes Medical Assistance Income Trusts for people whose income is above the ordinary long-term-care limit (Iowa HHS LTSS overview; Iowa HHS Medical Institutions manual).
The pivotal Iowa financial rule is a hard income cap, not a general long-term-care spend-down. Iowa HHS lists the 2026 300%-of-SSI limit as $2,982 per month and permits a qualifying Medical Assistance Income Trust, also called a Miller Trust, to exclude income paid into the trust for eligibility and client-participation purposes. The trust has a state-payback requirement, so it is a compliance device rather than a free asset-protection arrangement (Iowa HHS Medicaid Income manual; Iowa HHS MAIT guide).
Home title is not a simple probate question
Iowa HHS policy defines the estate for recovery to include real and personal property, joint interests, trust interests, and retained life estates. That is broader than a conventional probate-only conversation and is why a deed, trust, or joint-title decision needs both eligibility and post-death recovery review (Iowa HHS Medicaid Resources manual).
The current Iowa Code chapter 633D concerns beneficiary-form registration of securities. The Legislature's HF 816 would create a real-property transfer-on-death deed act, but the official document labels it introduced; this page therefore does not treat a real-property TOD deed as enacted Iowa law (Iowa Code chapter 633D; Iowa HF 816, introduced text).
