Covered services extend beyond a nursing facility
HHSC lists nursing-facility services, ICF/IID services, specified HCBS waiver programs including STAR+PLUS Waiver, Community Attendant Services, and related hospital and prescription services among the recovery categories. Being on an interest list alone does not count as applying for MERP purposes (HHSC MERP handbook).

The verified home safeguard is an administrative hardship waiver
Under 1 TAC section 373.209, a hardship request must be made within 60 days after the MERP Notice of Intent to File a Claim. The rule says MERP will not recover when recovery would cause undue hardship and sets categories for potential relief (1 TAC section 373.209).
The rule includes a homestead-specific provision for qualifying heirs: a home under $100,000 in tax-appraisal value may be exempt, and where the value is higher the first $100,000 may be exempt, subject to the rule's inheritance and income conditions. This is an affirmative administrative hardship-waiver process, not an automatic exemption (1 TAC section 373.209).
Do not turn homestead language into a constitutional guarantee
