Texas MERP is a probate claim

Texas operates a probate-only Medicaid Estate Recovery Program rather than an expanded-estate program reaching every non-probate asset. HHSC describes MERP as a Class 7 probate claim filed against the deceased recipient's estate under the Texas Estates Code and Chapter 373 rules (HHSC MERP handbook).

HHSC says Texas implemented MERP on March 1, 2005. It applies where a recipient was age 55 or older when covered services were received and initially applied for covered long-term-care services on or after that date (HHSC MERP handbook).
