Delaware applies the five-year transfer review
For long-term-care Medicaid applications and transfers on or after February 8, 2006, Delaware’s Medicaid long-term-care policy uses a look-back date 60 months before the baseline date. The baseline date is the first date on which the person is both institutionalized and applying for medical assistance; transfers after that baseline date can also be penalized if made for less than fair market value (Delaware Social Services Manual, transfer rules).
The policy treats an asset transfer broadly. It includes an asset sold, given away, placed in a trust, contributed to charity, or otherwise transferred by the individual or spouse, including some transfers made by another person acting on the individual’s or spouse’s behalf. Fair market value and actual tangible compensation must be documented; the manual says love and affection are not fair-market-value compensation (Delaware LTC transfer policy).
