Virginia's basic LTSS resource rules

Virginia's 2026 policy lists a $2,000 resource limit for one person in the ABD categorically needy or medically needy groups and a $3,000 limit for two people. Those figures are basic resource standards, not a statement that every married LTSS applicant has only the two-person limit available: special community-spouse rules can protect a separate amount when one spouse is institutionalized (DMAS 2026 resource policy).

The same current source identifies $2,982 per month as the 2026 300%-of-SSI income figure for a one-person ABD categorically needy group. Virginia also publishes medically needy income limits that take effect July 1, 2026 and applies spend-down rules in its LTSS manual. This makes Virginia different from states that present a single hard income-cap answer: an above-300%-of-SSI result should be analyzed for the medically needy route and current patient-pay rules rather than assumed to require a Qualified Income Trust (DMAS 2026 income charts; DMAS Chapter M14).

Home equity and the community spouse

For people seeking Medicaid payment of LTSS, Virginia's home-equity limit is $752,000 effective January 1, 2026. The policy calculates equity using tax-assessed value minus encumbrances. The limit does not block payment when the home is occupied by a spouse, a dependent child under 21, or a blind or disabled child of any age; the home rules are technical and should not be confused with the later estate-recovery question (DMAS 2026 home-equity policy).

Virginia's community-spouse resource standard is $32,532 effective January 1, 2026, with a maximum of $162,660. The manual describes the spousal share as one-half of the couple's combined countable resources at the beginning of the first continuous period of institutionalization; after eligibility is established, only the institutionalized spouse's resources are counted for that spouse's continuing eligibility. The community-spouse assessment is therefore both a date-sensitive and documentation-sensitive calculation (DMAS Chapter M14).

Use the current policy, not an old chart

The income figure, home-equity ceiling, and spousal floor are published in different parts of the Virginia manual and can change on different effective dates. A home can be excluded for eligibility and still be relevant to estate recovery; a resource assessment can protect a community spouse without eliminating all patient pay.
