South Carolina uses a 60-month transfer review

SCDHHS’s published long-term-care manual applies a 60-month look-back period to uncompensated transfers. In ordinary language, the agency reviews transfers made during the five years before the relevant long-term-care Medicaid application period. The review is not confined to gifts called gifts: a sale, deed, transfer into a trust, or other transaction can require proof of fair value and consideration (SCDHHS MPPM Chapter 304).

The practical question is whether the applicant received fair market value. Families should retain closing statements, appraisals, checks, contracts, invoices, care agreements, bank statements, and proof of payments before an application is filed. A later explanation without contemporaneous records may be much harder to establish than a properly documented transaction.
