Whose services can trigger recovery
HCA states that the program applies to members age 55 or older who received long-term-care services, including nursing-facility care, home and community-based services, and related hospital and prescription-drug services. The estate-recovery rule describes the same age-55 and long-term-care framework (HCA New Mexico Estate Recovery Program guide; HCA 8.200.430 NMAC estate-recovery rule).
Recovery is deferred while there is a surviving spouse. HCA also says recovery does not apply while there is a surviving child under 21, blind, or permanently disabled, which is a protection that should be documented promptly when HCA contacts an estate (HCA 2026 estate-recovery brochure).
Hardship and other relief are case-specific
HCA says some estates may qualify for an Undue Hardship Waiver where recovery would cause significant financial hardship to heirs, including loss of a primary residence. The agency says the waiver is not automatic, is evaluated case by case, and must be requested with supporting documents (HCA New Mexico Estate Recovery Program guide).
HCA also identifies exemptions for certain Native American income, resources, and property, Medicare Savings Programs, and ABLE accounts. Its guide says heirs are not personally liable because the claim is against the Medicaid member’s estate; those statements do not remove the need to respond to estate notices or obtain individual advice (HCA New Mexico Estate Recovery Program guide).
Plan titles and estate administration together
A family should preserve the decedent’s title documents, probate filings, care and payment history, beneficiary designations, and information about any surviving spouse or protected child. The scope described here is New Mexico’s published probate-estate scope; a personal representative should confirm the current law and procedure before distributing property.
