What AHCCCS can recover after ALTCS benefits

Arizona law directs the AHCCCS director to adopt rules that allow a claim against a member’s estate to recover paid assistance and also entitles AHCCCS to a lien on a member’s property, in each case consistent with federal law (A.R.S. § 36-2935). The statute requires a personal representative to notify AHCCCS of the estate or property within three months after the death of a member who was at least 55, if AHCCCS has not already filed a statement of claim in the estate proceeding (A.R.S. § 36-2935).

AHCCCS policy says estate recovery applies when a deceased person received ALTCS nursing-home or home and community-based benefits at age 55 or older, with benefits received on or after January 1, 1994. The stated claim is the total ALTCS payments made for the person at age 55 or older; the policy lists capitation, qualifying fee-for-service payments, reinsurance, and certain older Medicare costs among recoverable payments (AHCCCS estate-recovery overview).
